Terms and Conditions of Sale

Preamble

These Terms & Conditions govern the sale of products offered by VILAC on its website www.vilac.com.
By clicking “I accept the Terms & Conditions of Sale”, you agree to these terms. By clicking “Confirm my order”, you confirm your order permanently.

 

Article 1 – Purpose

These Terms & Conditions define the rights and obligations of both parties in the online sale of VILAC products. Sales are reserved for adults or minors with parental authorization.


Article 2 – Products

The products available are those shown on the website, subject to stock availability.
In case a product is out of stock, customers will be informed promptly. If unavailability lasts more than 30 days after payment, the order will be cancelled and refunded.
Product descriptions and photos are provided as accurately as possible but are not legally binding.


Article 3 – Prices

Prices are displayed in euros (€), VAT included.
Shipping and packaging fees are added at checkout. Shipping is free on orders over €40 for France and €60 for other countries.
Prices may change, but orders are billed at the rate in effect when confirmed.
Products remain the property of VILAC until full payment is received.


Article 4 – Orders

Customers must create an account to place their first order.
Items are added to the basket using “Add to my cart”, and the order is confirmed by clicking “Proceed to checkout”.
Confirmation requires entering a valid email and password, which serve as proof of identity.
Customers must be at least 18 years old or have parental consent to order.

Article 5 – Payment

Orders must be paid in full at the time of purchase.
Payments are accepted by credit card (Visa, Mastercard, Eurocard) or PayPal.
VILAC reserves the right to refuse an order in case of prior disputes, failed payments, or fraud suspicion.


Article 6 – Delivery

We deliver to Metropolitan France (including Corsica), Germany, Austria, Belgium, Italy, Spain, and Portugal.

We offer four delivery methods: Colissimo Home Delivery / Colissimo Collection Point, and DPD Home Delivery with appointment (DPD Predict) and DPD Collection Point (DPD Pickup).

Failure to Collect an Order from a Pickup Point

Where the Customer chooses delivery to a pickup point, the Customer undertakes to collect the parcel within the period specified by the carrier.

If the parcel is not collected within this period, it will automatically be returned to the Seller. Any return charges invoiced to the Seller by the carrier, together with any reshipment costs, shall be borne by the Customer.

Upon receipt of the returned parcel, the Seller will notify the Customer by any appropriate means and will offer either:

  • a new shipment, subject to prior payment of the applicable shipping costs; or
  • a refund of the order.

Where a refund is requested, it shall be processed as soon as reasonably practicable after deduction, where applicable, of the return charges incurred by the Seller as a result of the Customer's failure to collect the parcel, to the extent permitted by applicable law.

The Seller will retain the returned goods for a period of thirty (30) days in order to allow the Customer to contact the Seller and choose one of the proposed solutions.

 

Article 7 – Right of Withdrawal

Customers have a legal right to withdraw within 14 days of receiving their order.
Items must be returned in their original packaging, by post only, at the customer’s expense.
Upon receipt of returned goods, VILAC will refund the purchase price within 30 days.
Sale items or promotional purchases (clearance, private sales, flash sales, etc.) and personalized toys are not eligible for return or refund.

Article 8 – Product Availability

Products are valid as long as they appear online, subject to stock availability.
If an item becomes unavailable after an order is placed, the customer will be informed by email and refunded automatically.

Article 9 – Guarantees

VILAC products are covered by French consumer protection laws:
Conformity Guarantee: Products must match their description and be suitable for normal use.
Hidden Defects Guarantee: Covers defects making a product unsuitable for its intended use.
Customers may request repair, replacement, price reduction, or cancellation in accordance with French law.

Article 10 – Liability & Safety

All VILAC toys comply with European Standard EN71 and carry the CE mark.
Products are tested by certified independent laboratories to ensure safety.

Article 11 – Data Protection

Customer information is collected solely to process orders. It will not be shared with third parties without consent. Customers have the right to access, modify, or delete their personal data (in accordance with French law).

Article 12 – Governing Law

These Terms & Conditions are subject to French law.
In the event of a dispute, French courts have exclusive jurisdiction.
